‼️‼️GUIDE TO PEACEFULLY PROTESTING AND DEALING WITH THE POLICE‼️‼️
Here is some information to protect YOU in the moment when dealing with police!
1. If you are stopped by police while on foot, ask them "am I under detention or arrest?". If they do not confirm that you are under detention or arrest you are free to leave.
2. If the police stop you when you are on foot and ask you for ID, you have NO legal requirement to give it to them unless you are being detained or arrested. However, if they stop you in a vehicle for a traffic violation, you are required by law to show your ID. PLEASE NOTE you do NOT have to get out of the car, nor open your door. Keep your door locked and your window down only as much as needed to pass information.
3. You have a right to protest on public streets, parks and other public places. You do not have the right to protest on private property, even if the public is invited, such as a store or a mall.
4. You should not speak to the police if you are arrested or detained until you speak to a lawyer or paralegal, and you are not obligated to as you have a right to remain silent.
5. Police must clearly identify why you are being arrested and let you speak to legal council promptly. And you have the right to speak to a free legal aid lawyer.
6. Do not refuse to give police your name and contact information if you are arrested, refusal will result in another criminal charge. Never give police a fake name or contact information.
7. Do not resist arrest, doing so can hurt you and cause you to be charged with more offences. If it's a wrongful arrest you can file a formal complaint and or sue later.
8. DO NOT AGREE TO ALLOW YOUR PERSON OR YOUR CAR TO BE SEARCHED UNLESS THE POLICE HAVE A SEARCH WARRANT.
