"On February 6th 2021, with no evidence, my right to peaceful protest was violated when I was arrested at Queens Park for ‘common nuisance’ for allegedly endangering the lives of others because I was in a group larger than 5 people, contrary to the Covid-19 measures. My speaker equipment was also confiscated and my rights were further violated with unreasonable restrictive bail conditions. Some of these conditions included being banned from the downtown core, not being able to posses sound equipment or even hold a microphone.

Quick synopsis:
Not long after my arrest, I made a request of the crown to withdraw my charge because my arrest violated the Canadian Bill of Rights under section 1a (liberty), 1d (speech). 1e (assembly), 1f (press) and section 2a (arbitrary treatment).
Fast forward a bit later, I received a random email from the crown offering everything to go away if I paid $100 towards my favourite charity. I said no which resulted in my first pretrial.

Once at the pretrial stage, the crown again made the same verbal offer to make everything go away if I paid $100 to my favourite charity… they also made it clear that if I chose not to take their “generous offer” I would face potential jail time, permanently loose my equipment and be convicted on a criminal charge after a very a long prosecution process. I advised the judge and crown that I intended to use the Canadian Bill of Rights in my defense. The crown and judge literally worked together in planning my own defense using the Charter. They tried to convince me to give up the Bill and go with their legal theory to use the Charter as my defense or to take the deal. They belittled, intimidated, bribed, coached and charmed me to no avail for 4 hours total in my judicial pretrials (my pretrial was one on one with a judge and senior crown).

I did not abandon my intentions to use the Bill without the Charter in my defense. As well, I continued to refuse their deal. Therefore, after my pretrials a trial date was set for March 3rd, 2022. Now that my trial date was set, I filed an application to the court to withdraw my charge because of violations of the Canadian Bill of Rights. The hearing date for this application was set for January 31st, 2022.
After all their efforts to derail me from using the Bill or to take the deal, they finally capitulated and the crown sent me an email on January 31st advising me that they were withdrawing my charge on the same morning of my Bill of Rights application. The hearing opened that morning with he crown advising the court that they were withdrawing the charge. The court did process the withdrawal.

Contrary to the Wikipedia myth that the Charter supersedes the Canadian Bill of Rights, the Bill is still in full force and effect today and is far stronger than the Charter because it does not accept the notion that there can be justified reasons to override your rights like the Charter does in section 1.
Without free speech we have no capacity to assert our other rights! Obviously we have serious problems with our current system but this experience has given me some hope that if we maintain our rights which are under the protection of the Canadian Bill of Rights, justice can prevail."
