I guess it's gray area since it's on the internet. Also, they don't use it to gain money, AFAIK.

GF/ Nintendo/ TPCI has never shut down fan projects as long as they weren't used to make profit.

It should also be noted that PS is open source, so even if they'd shut it down someone else would probably just put it up again.

I can't help but feel that's kind of pathetic. Serebii and Bulbapedia were hacked at the same time by the same guy. Bulbapedia has the wiki juggernaut infrastructure behind it, so them leaping back up is understandable, and Serebii was able to put things back together on his own.

Smogon just crumpled at the first sign of trouble.
