There is legal precedent for when it would either threaten state/national security or be a clear and present danger - cf. Oliver Wendell Holmes's remarks vis-a-vis "fire in a crowded theater".

Nevertheless, there is no real legal justification for the banning of video games under any argument. None of them really hold water.

supreme court says dog fighting videos are protected under free speech

nothing is at risk for video games
    >> Anonymous 05/11/10(Tue)15:28 No.58773XXX
It's not a ban, it would make it illegal to sell to minors, like beer or cigarettes. And the 1st amendment is a little more flexible when it comes to rights for children.

The Supreme Court might do actually, if only for the precedent so in the future they can control anything being sold to minors by pointing at this decision. Games being the scapegoat of the day get it first, then movies, and music, hell why not pop and candy, that shit hurts kids. Then again I look forward to the day where 12 year olds are giving handjobs in a back alley for some jawbreakers.

Are you fucking retarded? Why the hell would we design a system where states have equal representation in a national body if that body had less power than state legislatures?

Think about the shit you're spouting for half a second, jesus.

in fact, there were several states that had clauses set that would allow them to legally leave the union should they feel the federal goverment started overstepping their power.

What was written? The fucking Constitution of the United fucking States? The document at the foundation of all legal, political, and civil matters involved with the United States government? But that's not the way it was "supposed to be" according to whom? Early 19th century robber-barons, or just the people who think they should decide whether black people are actually "people" when they're within the confines of their state?

Not trying to argue, but the south would have won if they would have attacked. They really only fought defensive battles and where kicking the shit out of the North, but you can't win by defending.

the Union/North won the US Civil War

    That it?
    >> Anonymous 05/11/10(Tue)15:36 No.58773XXX
Honestly, I support a legal ban on the selling of violent video games to minors.

There's pretty significant evidence (yes, evidence, as in empirical, causal, experimental and archival and correlational evidence) linking it to violence in minors, especially as a developmental influence (i.e. when children are growing up).

    >Implying Religion isn't usually shown in those coming from poorer backgrounds, as studies have shown those who come from richer backgrounds tend to not need Religion to make it through the day.
