Under UCC Article 4, a bank is under no legal obligation to grant you provision credit.Sure, some may do, subject to the bank-depositor agreement you signed when you made your account, but there's no responsibility to do so.In fact, granting you provisional credit may be a liability for them. If you withdraw the money, then the check is fraudulent, they're left holding the bag. However, in such circumstances, the check was duly negotiated (having you withdraw funds is the "for value" prong of the three-prong test for due negotiation). So, their only recourse is suing the person who wrote the check. Unlikely.Cry some more.
