An important distinction here is between parody and satire.

PARODY is imitating a work to make fun of the work itself, and is protected as fair use.

If PETA can argue that they're pointing out the hypocrisy of pokemon, it may be upheld as parody, but if Nintendo successfully argues that they're using pokemon to make an unrelated point then the game won't be legal.
