    I was canned because I went off on a customer, even though he really deserved it. But stupidly I gave a statement and signed it, and *that's* that they're going to use against me.

    But Caliofrnia is real liberal, so they probably won't want to drop me, but almost half of all claims get denied.

    Say no. Always say no. Even if you had signed something previously.

    They do not cross examine you. The adjudicator takes your story and then takes the other person's story. Then examines them. They usually side in your favor, and if they don't the first time, appeal. Say you were really upset when you made the statement, if they bring it up. Say how you don't understand how telling a customer that you could refuse to serve (dumb down whatever it is you did to something like that) could get you fired.
    Should be fine.

    I got one mailed to me the day before.

    I got a normal one one handed to me as I was canned for full benefit rate for that last week.

    Those are the two that count.

    Then there was another normal one in the mail a week later, for like a buck or two.

    So three checks, sorry.

    In any case this is your best bet. It is essentially claiming duress when you signed the paper thing or whatever. In the phone interview, tell them when they ask you if what you signed and wrote is true, say it is not and that you are unaware of why they say you were fired and instead not laid off. Then tell them they told you they would not have paid you unless you had written and signed the statement they said. And being as you have to pay your own bills you would of been homeless, with out food, water, etc. Then you should be good. It is essentially saying the company didn't want to help pay for your unemployment and decided to lie to the government about you being fired and since it is your word against theirs, you will have nothing to lose.

    I had a friend who claimed UI benefits for two months after being fired, and they did not contest. When he had to start them up another two months later, the company contested. The UI chick said tough tits you should have caught this before, if it were a real issue and he had not been laid off you would have contested immediately.

    In the state of California, you can apply for and receive unemployment benefits if you became unemployed for ANY REASON as stated on the EDD website.

    Furthermore the money you get comes out of your income tax that's taken from your paycheck.

    If they phone interview you, state that they did not warn you (legally in california, you are supposed to get 3 written warnings). I'm getting ready to sue my last employer because it's been a year since i've had a job, can't get an interview and am about to get m last unemployment check because I hardly had any money coming to me.
