hey got a question, in states where you can open carry, why does the gun have to be unloaded? doesn't that defeat the purpose of having a gun? when you carry concealed you can have it loaded right?

I just dont understand why they do those checks to see if its loaded or not when you open carry.
    >> Anonymous 04/19/12(Thu)11:05 No.11419220
california was the only state (that i can think of) that had unloaded open carry. and yes it was stupid, but people got scared and such. open carry is now illegal in california, concealed only, and that's assuming you have a permit in the few counties that issue them.

Congratulations, you have now figured out that open carry is an absolutely retarded idea that should not be done by anyone unless you are carrying in the wilderness or wilds where you are afraid of being attacked by animals, not people.
OCers are just dumb attention whores who are likely not smart enough or educated enough to be carrying a gun in the first place.

Texas is one of the most gun-friendly states in America (scored a 4 on the Brady scale), with excellent self-defense and castle laws. And we DO NOT allow OC. Why? Simple. In Texas, we do not permit faggotry.

It's a Gen 3 G19, not a Gen 4, although I do plan on buying a Gen 4 G17 or G19 some time this year after I buy an SGL-31 to accompany my SGL21. It's a 2009-2010 manufactured G19 and has been an exceptional shooter with about 12,000 rounds through it so far once I finish up this box of ammo. Hasn't had a single malfunction that wasn't ammo related, but I did replace the spring assembly with a new factory replacement at about 6,000 rounds just for good measure. Hoping to get a Gen 4 for that awesome accuracy, hope they have most of the kinks worked out by now.

well, you do sound kinda mad.

In fact I did call up the police after a community watch meeting, because the maps they made to display 911 calls+arrests were so shitty, I wanted to volunteer my services in making better ones.

I asked about how many people call to complain about people using guns, and they were all along the lines of

    >my neighbor/some kids/a suspicious looking guy is shooting/my animals/at night/at my house and or property

Even the police assume you have guns when they stop you, and still don't care as long as you transport them legally.

As for California, can you provide evidence of other states doing the same? I discount California (as well as other 'communist' states) because the political situation there seems to be far more antigun than most of the country.

ITT: anti-gun faggots who want OC banned.

I think it's fine to make fun of or otherwise criticize OC'ers, but going so far as to want OC banned? WTF?

In Texas, if your CC'ed firearm gets exposed you can be prosecuted for OC, which is total BS. OC bans are total BS. There are many situations where OC is preferable and won't draw attention.

I almost always CC everyday and I don't OC in general public, but I have in other situations, like innawoods and on range/shooting trips with friends, and want the ability to do so.

tl;dr: if you want OC banned you are a Brady faggot. fact.

Serious question: why does it seem like OC'ers are more likely to be really fat?

Is it harder to CC when you are really fat? I understand that having some extra weight is beneficial, but is it really uncomfortable for really fat people to CC or something? I have no idea because I'm skinny as hell.

disclaimer: most of the few people I've seen OC were normal sized. It just seems like there is a higher % of fat OC'ers than the general pop.

Suuuuurrrrre you're not trolling. What happens if you CC'ed firearm is spotted by some one? You have just illegally OC'ed and will now lose your CC license. So yeah, TX OC laws are retarded. Not to even mention the myriad of instances where OC does not attract attention at all.

A lot of states have exemptions to allow permitless carry in certain instances and/or for certain people. GA for instance allow permitless carry for anyone who have a job that is listed on a rather extensive list of exemptions in the law. This includes anyone in the US military. Many states (basically all of the somewhat progun ones) allow permitless carry on private property you have permission to carry on. I think CO has some exemptions too, but I'm not sure what they are exactly. I do know that they don't affect me and that my CCL covers me anyway.

Oh. See, in Texas, EVERY TEXAN can CC provided they are in their vehicle, on their way to their vehicle, or in a place that's under their direct control. That's how the law reads, and it's pretty broad-- and broadly interpreted. Basically, all you need a CHL for is to carry into restaurants, shops, things like that.

This law pretty much makes it illegal to IWB CC without a trench coat if you ever want to bend over and pick something up or something.

In that statement you are using direct logical fallacies, chief amongst those being you attempting to discredit ALL of the BS prosecutions for an accidentally exposed CC'ed firearm. Some of those cases may have been bad CC practices (which still isn't attention whoring, like you are railing against, and therefore should still be A OK by all of your arguments, which again makes the TX OC law a bad law by your own admission), but not all of them are. Some of them are people who are being victimized by the blatantly anti-CC law.

You are admitting that people are prosecuted under the OC law for CC'ing in an otherwise acceptable fashion, but won't admit it because you are trolling or just retarded.

Know why they put that in there? To keep faggots from screaming bloody murder every time some poor guy bends over to pick up a bag of Puppy Chow in WalMart and prints or exposes his handgun. With the word "intentionally" there, the cop responding (if there is one) must make a determination if the brief exposure was intentional or not. If he decides "yes" (and he'd better be DAMN sure of his case under pain of being sued to oblivion) then it's up to the court to decide if, in FACT, the hapless man "INTENTIONALLY" exposed his weapon. Which, if he was carrying IWB normally (shirt untucked, jacket/coat on, etc.) they will not be able to do. That is why I said that the only people prosecuted for exposing their CC weapon were the real, total fuckups. Learn your laws before you try to talk shit or troll bro.

The fact that it is illegal to OC, intentional or not, STILL opens up a CC'er to prosecution for OC for an accidental exposure. It becomes a he said she said thing, and an anti-gun police/DA might not care what you have to say.

I prefer to live in a free state where if my firearm is exposed, I don't have the THIN legal defense that it was an accident. It could even be argued that by not concealing deep enough a person intentionally meant for it to be exposed at some point. Texans are THE most defensive people I know of. Your state is flat and lame. You get all mad about it just like the people who live int the middle east do. You know where you live is boring and pointless, so you just deny it and take your anger out on people who live in interesting and worthwhile places.

Anyway, how are anti OC laws a plus? They would negatively impact me when I want to OC (rare, but I do do it innawoods and such, as mentioned before) I haven't seen some one OC in public in over a year and a half even though I hang out in mostly very pro-gun states.

The whole anti-OC thing seems like a very trivial and selfish argument. Loose more than you "gain" even though you aren't gaining anything other than "feeling better."

Essentially it is the exact same argument as the Brady faggots use for everything. Don't be a Brady fag, just ignore OC like normal people do. (as if it even common enough to notice in the first pace)

As per that law the word of the witness could be used against the CC'er even though the witness would have to have the ability to read minds to actually discern if it was an accident or not. ITT: you create the strawman argument where you presume that all witnesses will maliciously lie to a peace officer, and testify that the failure to conceal was intentional.

PROTIP: I've accidentally failed to conceal a whole bunch of times, and I'm still not in jail.

Once was even in front of a maintenance guy in a rest area on I-10. I came out of the shitter with my shirt literally tucked behind my roscoe. The guy had a fucking radio and cell on him, and nothing happened.

    Hey Zed

    You're an ass.

    Okay, me time now.

    RE: printing while CCing

Zed is technically right, as per Sec. 46.035 of Texas state penal code.

However, it does not specifically address printing of a concealed firearm.

It has something a tad worse:

    >A license holder commits an offense if the license holder carries a handgun on or about the license holder's person under the authority of Subchapter H, Chapter 411, Government Code, and intentionally fails to conceal the handgun.

It is a class A misdemeanor

it is also a judgment call, as printing could be taken as 'knowingly' carrying your handgun in such a way that it might print, as in you knowingly did not take steps to ensure 100% concealability.

Protip: it wasn't a strawman argument, but it was an unlikely hypothetical.

I took their argument at face value, but I suggested a possible point of it's failure. The courts may be reasonable about that point of failure or not. Generally they probably are and that is why my argument was wrong, not because of a strawman.

    Learn 2 logical fallacy.

In case use guys are blind: I was intentionally fucking with the Texans, and a lot of what I said about the law isn't really correct, but it made them defend it.

However, my original criticism of anti-OC laws still stands. The anti-OC law is pretty much pointless and adds an inconvenience to non-attention whoring OC'ers at no tangible gain to anyone.

It's all moot though because I am victorious because I say so.

Basically part of what I was arguing about it. Poorly constructed law. The application of it i bet is acceptable, if you find banning OC to be acceptable that is.

This TX law will go the way of the Ivan Chesnokov though, so it won;t have to be put up with by Texans for too much longer, I hope anyway.

    Actually THAT is a strawman.

I never claim such, only that it was possible and that a witness wouldn't have to lie to be incorrect about the INTENTION of the perp. A witness cannot read minds and that is what the law implies to determine accidental from intentional. Variations on intent can be argued as well, such as if having the chance of it being seen implies intent.

Again caselaw should say one way or the other for this. It seems to allow some leniency on slips, but I'm too lazy to bother looking it up.

"Intent" has very specific legal implications. Basically, if you're using an IWB holster, there's no case for intent. That's why the law says "intentionally".

Trying to redefine the legal imperative to prove "intent" to try and say "HURR DEM COPS CAN PROSSECUTE YA FER ANYTHIN" is just pic related. You guys are trying way, way to hard.

Basically, the argument that "HURRDUUR IT OPENS U UP TO PRAWSEKUSHUNS LOLOLOLOL" has the same legal merit as saying someone who walks into a kitchen supply store, and picks up a chef's knife to look at is now open to prosecution to anyone standing nearby who decides to scream "attempted murder!"

I mean, to say that a law is bad because you interpret it (incorrectly) to mean that you are left open to prosecution is to bring into question every law ever written. Put another way, the axiom that "You may beat the rap, but you won't beat the ride" as a reason to judge the inherent utility of a law is just asymptomatic of a mind that simply doesn't think about things too deeply, and has really no idea how the justice system works. It's the "Obama gon git aer gunz!" of legal theory. Naturally, intelligent people discard it out of hand.

    But it's funny to watch.
