The problem with the "anyone might be on their list" argument is that if it was true, then their lists would be useless.

But people are too much of a bunch of moral cowards to make the real argument: the people who really get on their lists are more likely to be terrorists (e.g. Muslim or right wing extremists) but those people deserve privacy as long as they stay within the law.

So if people weren't a bunch of cowards they would be advocating using Google translate and browsing and posting on Islamic extremist sites. But that isn't a palatable message.
