Well, I think this topic fits here. It seems that law enforcement has a tough job when handling device encryption. The judges are wrongfully siding with them to create a landmark case with their name on it. It's a jury of your peers. If you are the one standing next to the defense attorney the assumption is you are already guilty, people will think this no matter how many jury instructions they get. You have to prove your innocence.

It really is guilty until proven innocent now and unfortunately there is no way to change it. It's not only a problem with the justice system itself but a problem with people and how suspects are viewed by the common man and portrayed by the media. This is not something that will change overnight.

He wasn't forced to decrypt the drives in the previous order as the prosecutor could not prove the drives belonged to him as they had no access to it. Under the 5th Amendment he was under no obligation to decrypt the drives as that would prove he owned the drives and such he would be committing self-incrimination.

However because the FBI managed to decrypt one of the drives and found personal and financial information that proves the drives belong to him, it's no longer against the 5th Amendment for him to be forced to decrypt the drives as it's already been proven the drives belong to him.

That's not how the 5th amendment works.

The 5th amendment prevents the government from going fishing to find things to charge you with by making you tell them. If they already know that there is incriminating material present, you can't plead the 5th to avoid turning it in.

If a police officer walks into your room and sees child porn on your computer, but you lock and encrypt it before he gets to it, then he has probable cause and eyewitness testimony that you have illegal material. The judge is allowed to compel you to turn in the password / decryption keys.

If they think you may have child porn on an encrypted hard drive in your computer but nobody has any actual evidence or even reasonable cause for suspicion that this would be the case, they can't ask you to decrypt it for them so they can find things to charge you with.
