That's not a bug. The move tool moves the layer. You need a floating selection if you want to move it. The only reason why you expect it to work without a floating selection is because you've used Photoshop.

GIMP devs are actually working on removing the concept of floating selections though, so they might actually change it to work they way you want soon, but they need more developers to make that happen. Making a fork is still pointless.
