http://betabeat.com/2012/11/4chan-founder-moot-sends-cease-desist-letter-to-startup-moot-it/
>4Chan founder Chris Poole, who has gone by the username Moot since 2003, has sent a cease-and-desist letter to Oregon-based startup Moot. It, a yet-to-launch company that promises to reimagine forums and commenting. We initially suspected the letter might be a prank from /b/, but confirmed with Mr. Poole’s lawyer, Martin Schwimmer, that it is indeed real.

Quote his lawyer:
>Fair enough. The letter is authentic.

>>
>>29208687
Well there doesn't need to be a trademark in US law at all actually.

If i make a can of soda look just like coke but I call it cancerous sugar water, if it looks enough like the coke can even without the name being close it's grounds for a lawsuit and a forced change of the can design.

That's just an example.
Also, it wasn't a C&D since the company hasn't started yet, it was just a letter "if you go forward we'll pursue legal action" kind of thing.

From what I know from a few classes of IP law, moot has a pretty good chance on this.
>>
>>29208701
he has to prove a relationship to him and the other website. it's like stealing someone's name as a product endorsement. i really think this is a garbage case, but the other guys probably can't afford attorneys to respond to the C&D. moot is just being a jew, not unexpected from someone living under the jewish island of manhattan.
>>
>>29208823
How is this him being a jew? He's not going to see any money from this and likely this is some 3rd rate terrible social site that pops up that won't be successful either.

It's more about consumer product confusion than any type of money making.

>>
>>29208812
registered trademarks are much easier to argue in court because their is a presumption in your favor.

the design of the coke bottle is trade dress, it is protected so long as it's unique and recognizable by the public.

>C&D since the company hasn't started yet, it was just a letter "if you go forward we'll pursue legal action" kind of thing.
that is what a C&D is. you ask someone to cease and desist from actions you believe to be infringing on your rights. the company exists even if it sin't registered, it would be a sole proprietorship.
>>
>>29208737
I was referencing the thread where moot shit on web sockets and JSON, only to implement JSON several months later
Although, in his defense (I was just being a trolling faggot originally) it'd probably be pretty big project to rewrite 4chan with sockets (the way the codebase is now)
>>29208869

>>
>>29208909
No, that's not what a cease and desist. There's nothing to cease because nothing has started yet. Read the letters.

Trade dress or not, product confusion is all that matters and I think moot has a good chance of a case where people would be confused between moot and moot.it and the lawyer does too, obviously, since they're pursuing legal action.

maybe people on 4chan would be confused. in a jury you wouldn't get the same result. they are betting it won't go to jury and they can bury the other guy in legal stuff.

>There's nothing to cease because nothing has started yet
they're using the name moot.it so something has started.
>>
>>29208812
Well no but it would make it easier to take down. I just don't see "moot" being a common enough thing to outweigh it being a dictionary word, that and it's just his handle not an operating business.

Nope I only have one public domain
>>
>>29209130

That's not how businesses or the law works. The site hasn't started yet therefore there's nothing to cease. Honestly, read the letters.

I disagree about the jury thing. 4chan has millions of visitors, and most of them are /b/ idiots who would easily assume moot.it = some other shitty site moot made. That's a walk in the park case for any jury to agree.

>>29209130
Dictionary word doesn't mean anything though. If I say Apple you think of macs, it's the same idea. If there's enough name-to-product kind of attachment that's all that matters. Right now, almost everyone associated moot with 4chan. That's all he needs.

>>
>>29209274
Because people associate moot with 4chan and 4chan is huge. That's really the only big thing on moot's side on this and it's a big piece of his argument.

About the handle thing, if you were some really popular internet cute site called myimouto.com and people started another site, primarily about being cute called imoutomy.com, there would be some confusion. I think it's close enough for it.

The big thing though is just convincing the jury there's enough people on 4chan and that there could lead to some confusion.
