19 KB NBC threatens to cancel partners who don't sign a "grassroots" pro-SOPA pledge Anonymous 11/29/11(Tue)16:55 No.21342082

    >We are writing to ask you for help on an issue that is one our top business priorities – content theft on the Internet, which is a major threat to the strength of our business. Our major guilds and unions are joining us in the fight to keep our businesses strong so that the tidal wave of content theft does not kill jobs. But if the current trend continues, it’s not too strong to say that this threat could adversely affect our business relationship with you.

tl;dr NBC is strong-arming business partners to sign a pro-sopa pledge

It's a great thing that I don't live in the US.

In Aus the high court recently ruled that ISP's have no responsibility for the action of their clients, something which the film lobby and ACTA don't agree with.

    So far.
They're trying to appeal the case but it won't go through, they've found in favour of iiNet in basically every level of court.

However, a group of 5 ISPs including Telstra, Internode and iiNet will be implementing a voluntary copyright infringement notice system, similar to what a DMCA notice is.
But they won't disconnect users, they'll pass on the IP address and other evidence to the film industry lawyers.

I pay the extra $10 a month for dvr, but I see where they are coming from. You can't just pirate a show off basic cable, and think it's okay. I agree this should be a felony, even if you pay for cable and dvr. The commercials are what pay to keep these shows on the air, and if your not watching the commercials and pirating your television you paid the right to view, your a criminal, and a felon.

Felons lose some of their rights, namely voting rights and the right to bear arms.

You just said that you believe that anyone who isn't supporting a TV channel by adding one to a "people who saw this commercial" counter deserves a massive fine, jail time, and two fewer rights, not to mention a slimmer chance of getting a new job.

I don't see why companies like TV networks hate piracy so much.

    >hear about new show
    >grab an episode from some illegitimate source
    >become a fan
    >start watching it on TV every week, driving up views

If you're promoting a passive method of consumption like TV, or a stage show, or something similar, it could be a great idea to let people view your content easily. It's a GOOD thing for networks.

Other than this case, people want on-demand services. If you don't offer them, piracy will always prevail – and no law can stop it, as technology moves faster than law can ever hope too. If you want to beat pirates here, give people a really great on-demand network for your stuff, where they can watch all of your shows instantly in HD, and they'll gladly sit through a few advertisements. It's much more convenient than piracy, and it'll still drive people back to your TV network to watch fresh episodes (and they'll often end up staying to watch another show).

The heavy-handed, "sue everyone!" approach may be legally justified, but it's immoral and it's bad business. The music industry continues to learn this the hard way – if the TV networks had any sense, they'd figure that out rather than bumbling around trying to retain an old business model rather than adapting.

I can understand their position to a point, as they do own the content. But as I said earlier in the thread, a company relying on passive consumption like a TV network would be best to turn a blind eye to it – it's almost a form of unpaid viral marketing.

If you see a great NBC show illegitimately, there's a very good chance you'll end up watching it (and likely other shows) on TV.

Don't quote me on it, but I remember hearing that NBC aren't great with on-demand stuff. If they're not going to offer a compelling alternative, they're going to end up like the music industry, spending a small fortune suing potential customers. If NBC offered all their shows online, in HD, people would watch them and almost nobody would pirate them. A legal option would almost definitely be easier to use and more convenient, hence people wouldn't even mind putting up with some advertising.

It's exactly the same as with the music industry: because it's so easy to buy a song from iTunes or Amazon now, far fewer people pirate music. With video content often involving more effort or technical skill to pirate, people would jump all over a good, legal on-demand service.

    >a lot of media companies are at a real risk of going under
That's not true. Besides, if piracy is such a problem for them, maybe they should be looking at ways to monitize it or use it to their benefit.

Holding on to old ways of doing business and litigating to maintain your position is not a business plan – it's practically an admission of failure. If they need draconian baby-sitting to keep their shit together, they must be doing something wrong.

To make a really piss-poor analogy, and demonstrate why I'm on an imageboard rather than writing fiction:
Say I sold oranges from a stall. I used to leave bags of oranges sitting next to a wall, where I thought they were safe. One day, the wall was knocked down. People started walking past and taking them for free.

Surely I should just admit that things have changed and I need to move those orange bags, right? If NBC were giving the orders, they'd tell me the bags are great just where they are, and to spend all day on the phone with the police tracking down orange thieves – all the while, people are still taking the oranges.

NBC and their colleagues need to realise that the wall is gone now.

Same poster here you replied to.

This is exactly what has happened to me on Thursday nights. I work over night hours and no longer have time to torrent in the morning all of the shows. I end up watching BBT and Parks and Recs live on TV thursday night and download the rest of my shows on a torrent over the weekend. I also started watching Two and A half Men live on TV just because I don't feel like waiting 3 hours on my day off for the seed/leech ratio to get high enough to download at a respectable speed.

So folks, what do you think they are going to blame once this gets put into effect and they realize that pirates are not their biggest problem but the quality of their own products?

It's easier to say, "piracy is killing our industry and people are starving", then, "because of multiple factors including, but not limited to, internet streaming, lack of interest, people blocking/skipping ads, increased competition, economical recession, etc. we don't see profits as high as we'd like to".

Businesses always clamor for a free market but one they can control completely. DIAF.

That just proves the point! If only people like NBC would listen to their customers, especially people who are technical and do know how to pirate. We're exactly the sort of people they should be consulting with – when geeks adopt or push for something, the general public will follow (this is also why HD got somewhere, but 3D is dead in the water).

We aren't out to get NBC or their competitors – they're a company out to make money in return for providing entertaining or interesting content, and that's totally fair. But if they're going to go out of their way to make their content difficult to access, and a free-of-cost alternative exists, we're more than willing to screw them. A business relationship works both ways – if you want money for your services, you better make them worth it.

You've pretty much also hit the nail on the head as to why services iTunes and Bandcamp are selling shitloads of music at a time when piracy is easy and accessible. Clearly there's some lessons to be learned here.

I hate to break it to you but pirating isn't mainly done by "technical" people but by "ZOMG you just download this program and it gets you free music!!11!!!1" people

    >why services iTunes and Bandcamp are selling shitloads of music at a time when piracy is easy and accessible
That's absolutely it, although I'd give Amazon some credit too as they're doing pretty well. I hate to say it, but I do pirate most of my music. When I've occasionally dipped into iTunes, and it's shocking simple and it has everything you could think of. I even showed my older mother, who is far from great with computers, how to use it.

Given the varying quality, bigger files sizes, confusing codecs, etc., video is even more difficult to pirate. They really wouldn't have to try very hard to make something more intuitive than a public torrent tracker and a BitTorrent client, which, let's face it, is pretty convoluted and messy. If you're on /g/ you presumably can figure it all out, but even if it goes against your geekier tendencies, there's a part of you that would love to click a big button and just watch The Office while you crack open a beer.

    >Clearly there's some lessons to be learned here.
I know I'm going to get torn to shreds for daring to post the following link (which I do with complete sincerity), but Steve Jobs wrote a piece about piracy, and said something fairly similar to us. It just popped into my head, and it's worth a read given that he was someone heavily involved with legal digital content distribution.

It focuses mainly on DRM and why it's a waste of everyone's time (a surprising sentiment from Mr App Store), but is still quite relevant:

Y'know, I'm really starting to consider writing a big-ass letter to NBC and friends about this, with some of what I've said in this thread.

Pity it'd probably be ignored, but maybe it's worth a try just to see what the response would be.
