Also, that is some straight up bullshit that they can do this without a warrant or probable cause. He probably won't even get it back either.

    Welcome to murrika.

Chances are he will never get it back. Its been known for a long time that homeland security just goes after random people just so they have an excuse for keeping expensive departments open. Shit like this is common, I wouldn't be surprised if the individuals related to the confiscation occasionally "lose" (See: Take home) items that are being searched.

Anything I download outside of the country I upload somewhere so if I can't get my laptop, I still have access to the files. Also, I make sure that when I do leave the country to do a complete wipe and re-install on my laptop. Then again, I'm the paranoid type.

Bought a bottle of Johnny Walker Double black in Madrid and went back to the states.
Homeland security took it from me, it was wrapped in the plastic they give you at the Duty Free, and they didn't even let me speak to his manager.
Lucky I had family waiting at the airport already for 2 hours and i didn't want to keep them waiting any longer, otherwise i would have made a goddamn scene and got my bottle back.

The trick is to never actually take the physical machine with you. Or failing that, leave your data at home and access only via the interbutt.

And make it a cheap lappie.

A friend of mine shipped a computer from Missouri to Woodstock ON to his future wife. By the time she received it after Customs got through it, it was physically broken.

And that was Canadian Customs, Before 9/11.

And just before you come back to the States, do a full restore or a wipe.

    "What's on your computer, sir?"

"Nothing. It is wiped for work security reasons"

    And away you go.

Yup. Having a huge event for 9/11 every year seems to work great for geting the masses to agree with them.

Oh, and don't forget laws like "Protecting Children From Internet Pornographers Act of 2011", which has nothing to do with protecting children and everything to do with warrentless information gathering on everything you do online.

well, first off, sending stuff like this cross border will have results like this all the time, especially to canada. Second, a wipe after gov inspections is always good, because it is legal for them to install a malware to track your every move on the computer.

Also, if you travel with a blank laptop, they will question you even more heavily, and probably confiscate it too, for further analysis.

there was an explanation on the search warrant, or the seizure form. I have copies of both of mine, and it tells you why they are taking, and what they can take. They have to be very specific. Overly broad warrants get thrown out, and overly broad searches get tossed all the time. See: Cell phone searches with no reason or cause in California, by California state patrol.

lol speedy trial, you obviously have no real world experience with the US legal system. if HS is nice they'll give it back in 6 months, if you go to court expect 2-3 years till all the motions are filed.

also in some states speedy trial only applies if you can show that the prosecution is intentionally dragging its feet.

The U.S. military is killing innocents TODAY, and for extremely dumb reasons; they're not conquering nations or establishing colonies, they're just pissing away money on an imaginary war. There's not a single reason they can't start pulling out their troops tomorrow. In fact, I thought Obama talked that very talk before being elected?
