  • We are still working on some of the outstanding CloudFlare issues. We are aware of an issue affecting IE users where all images are saved as BMP and are working on a fix. We will also be sending proper Last-Modified headers on HTML starting early next week (works on our end, waiting on a fix from CDN). And still tracking down the issues with posting/accessing sys.4chan.org.

I've gotten a few e-mails from Australian users about difficulty resolving 4chan DNS and accessing the site. If you are affected, please e-mail moot@4chan.org with more specifics like your ISP, and what the 4chan subdomains are resolving to (run "nslookup boards.4chan.org" and "nslookup www.4chan.org" from command prompt/terminal).

    Thanks and Happy Thanksgiving!
    Love, mootykins

Hey /b/, I just got something we all dread getting. I got a subpoena regarding something I downloaded. Good news is it is a huge case involving 1474 people(IP addresses) and I was just wondering what I should do in order to make this go away as fast as possible while spending as little money as possible.

reset ip and mac address and say there must be a mistake you don't illegally download anything.

Was your wifi point encrypted? If not, just say someone hopped on. All they've got is your IP...not the machine. Just cast reasonable doubt and you're good. they're looking for a quick settlement.

an hero. You can use a plastic shopping bag out of the nearest trash bin. Won't cost you anything.

Even if I cleared the MAC addresses from my router and told them someone else got on couldnt they still pursue the case further? And couldn't they blame me for having my wifi open?

USA or Europe? If Europe, you must encrypt to WPA by law. In the USA you don't have to. Wardriving is common. Hell, I do it all the time.

If someone used your IP or wifi point to download something it's not your fault.

As before, they're looking for a quick settlement. Not a protracted lawsuit.

Talk to an Intellectual Property lawyer. They often give a bit of advice for free.

If it helps, at the top of the documents it says U.S. District Court for the Eastern District of Missouri, where I do not live. Does this mean it falls out of my jurisdiction?

That's where they filed the subpoena. Probably closest to them.

Call your ISP. See if they assign a static IP to your address. See if it's a shared IP or NAT'd at any point on their network. Often it is, depending on ISP. If so, there's your reasonable doubt.

Again, talk to an Intellectual Property lawyer.

was it someone else's intellectual property or did you downloaded something illegal

out of interest what did you download? cp would be a much harsher case wheras piracy might be a bit easier to get out of

this is a really good point...what did you download?

If it's obviously illegal, you're fucked.

If it's just intellectual property (like Bittorrent or that Steven Segal movie you couldn't live without) you're in better shape.

One more thing, who should I actually be telling this to? I'm sure the company pursuing these lawsuits won't be very cooperative if I just tell them it wasn't me.

During the consultation with the lawyer. Call around. Someone will give you advice for free trying to get your case...

Document the shit out of your current network config. Call your ISP and see if they've turned over records. If they haven't make sure you notify them not to without a court order.

Good luck. Don't panic. It's a civil, not a criminal matter.

    >>364847505

Bwhahaha. Ok, I've seen this before. They're trying to shame you into a settlement. They'll publish the name of the porn you downloaded in the hopes that you'll settle rather than have it all dragged into court and look like an asshole.

    It's intimidation, pure and simple.

You just have to decide whether it's worth the drama of fighting.

    Your call.

but I'd still talk to a lawyer.

    Terrible advice.

The court will enter a default judgement against you. You're automatically liable then...

    >>364848107
That's not true at all. Quit trying to scare him.

In civil court they can't do that.

Ignore and postpone indefinitely, OP. Eventually they'll get fed up and do something else other than bother you.
    >> Anonymous 11/26/11(Sat)13:25:19 No.364848422
    >>364848253

Once again, you can take this advice, but then your ISP will be required to respond to the subpoena and release your personal information. If you do not take action the court could ultimately enter a "default judgment" against you, which means a ruling that you owe money to the company that sued you. A default judgment may be legally enforceable, and could be turned over to a debt collection agency or otherwise be used to collect money from you. It can also harm your credit rating.

Ive read a few things about sending in a motion to quash, which wouldn't require a lawyer and could get me out of it.

Also, it says if I don't object it my ISP will give out my information. How should I go about doing this?
