Broke NEET here

2 months ago I got a job but I had to go through training. After 1 week of training I didn't pass. So they let me go/fired me. Month later I get a letter saying they overpaid me 328$ on my paycheck.it was complete bullshit cause the numbers dont add up so I didnt pay them. I phone up human resources and tell them about it and they said they have no record but they have launched investigation and will contact me about it soon. month after that I never heard from them back and I get another letter with them saying they still haven't received money and now they are threatning to get a 3rd party collections company to come and get me

lol wtf can I do. I've been trying to get a job for the past 5 months. What kind of shit can they do to me or take from me?

I don't know but I can find out. My parents said they do have a lawyer.

I also heard I can report the company for bad business practices to the ministry of labour and they can get scared off but i have a feeling that will backfire badly

Depends on the nature of the job. If you were acting as a contract employee, (not having taxes taken out, or to be taxed with a 1099 at the end of the year in the US) and the overpaid money was ADVANCED to you for purchase of materials, fuel or supplies used in the course of the job, you would need to repay it and return unused materials.
If, however, the money in question was for salary or compensation an you were an employee of the company, you are under no obligation to repay.

Be polite, OP. If you are not obligated to repay, tell them you are not going to repay them. If they threaten to sell this to a debt collector, tell them that you already know that a debt collector won't touch a salary dispute, and if they want to go to court, so be it.
If you're in the right, you can make it so that they will lose a lot more than $328 in just trying to collect the debt. You can easily say this and still be polite, something along the lines of "We both know I'm correct here, and we both know that it will cost you a lot more than $328 to collect this, even if you could find a way to do so legally. If you want to go that route, I'm here all day, but you won't see one penny out of me without a court order, period."

You should be able to figure out if you're in the right or wrong. If you're in the wrong, you can also mail them $20 in pennies once a month. Don't make it easy for them- no checks or credit card.

Thank you. I actually just found a government agency number I can call regarding employment standards and according to their page online it fits my current problems exactly.
