    On a side note I'm upset that this person I'm sort-of friends with because she always brushes off my critiques about her art.

    I'm not being mean. She wonders why her stuff isn't selling and I try to tell her nicely it's because her anatomy is off. She doesn't want to study references because in her mind using references counts as cheating and/or copying so it's in line with art theft. And she also says she can't learn unless she sees it in front of her so video tutorials don't help at all. I've redlined a few things for her and she still says it doesn't help. And she never redraws her sketches. She treats them as the final thing even when there are things grossly off about them.

    I keep telling her to scale down the chins on her figures but she disregards it since everyone praises her. She keeps telling me "you always say that". Well duh. It's because your women look like they have severe man-jaw. Stop it.

    Also, this other girl is going to Japan (I miss it and want to go back) but spends a ton of cash on anime crap. She even wrote how she was happy that her husband wasn't mad that she spent over two hundred dollars out of their savings to buy something.

    I am sick of people who know nothing about copyright law jumping on the replica debate calling all actions "immoral" and "illegal".

    In the US copyright protects literary and artistic works, but not functional creations like fashion, recipies, perfume, furniture ect. The only exception is if the design is separable from the function, but then only the design in the barest form is protected. A dress with artwork on it (aka prints, logos) is protected, but only the print/logo is protected. You can make the exact same cut of the dress with the same pattern, fabric, colors, ect as much as you want.

    So only print dresses apply, and only the artwork itself.

    Japan's laws are even stricter to obtain but broader in application. Japan protects apparel, but the designer has to prove their outfit has never existed before, it's completely and utterly unique and a novelty. Then the novelty as a whole is protected, but only *exactly* like that in those *exact* colors and materials assuming it does not draw blatent inspiration from other areas. This makes registering non-print lolita pieces virtually impossible, because most are obvious derivatives from decades of historical fashion. Even if they do obtain copyright, the copyright only has 10 years and changing something as simple as the fabric, color, ect of non-print remake voids it.

    The EU is somewhere in the middle of the two.

    So if you want to bitch about replicas, you can really only bitch about prints and then only the print itself. Replicas of dresses (aka VM, MM, IW) or bags, or shoes even if the cut, colors, and fabric are identical don't qualify under US law, EU law, and a great deal of the time under Japanese law.

    REGARDLESS, you can tell that people who are getting all fired up about replicas have little to no knowledge about the fashion industry and legal systems as a whole. The invisible capitalist hand of fashion is the need to innovate new designs before current designs are knocked of and replicated to the masses to the point of saturation aka popularity, whether this be in mainstream markets or niche markets. Copyright exists to protect INNOVATION. NOT PROFITS. The profits in some areas of copyright law represent the incentive to innovate, but they are not the same. In areas like pharmaceuticals or literary work copyright protects the profits to repay and surpass the vast amount of time spent in development and hence the primary motive for innovation. In fashion the motive for innovation is the overpopulation and saturation of prior ideas. Fashion houses make money by staying ahead of the game and everyone else makes money by producing derivatives and copies until the brands produce something new.

    In short, it is the lack of copyrighted material compared to other areas and the proliferation of derivatives and copies that drives fashion, and this is reflected in the LACK of copyright laws in fashion. Seriously, there are less copyright laws in fashion than virtually any other artistic area you can think of by a HUGE margin, and fashion leads artistic endeavors (music, art, ect) in terms of profit and output by an equally HUGE margin. The US is the world's fashion leader in terms of both designer output and profit, yet it has the least amount of protection for fashion design among industrialized nations (ignoring China). Even countries like Japan and the EU, the scope of their copyright laws for fashion are few and far between when you compare the scope of their copyright for music, technology, ect. Part of that is because of the derivative nature of fashion with trends and history, but an equally large part is because market saturation drives the fast turnover of trends and styles. And market saturation is only enabled by derivatives and knockoff to the point that the style has become obtainable to everyone and is seen everywhere. Believe it or not, derivatives and knockoff exist in SYMBIOTIC relationship with brand names within fashion. Whether or not you find that system *moral* is SUBJECTIVE and up to you. It might be REALLY IMMORAL or maybe not, but it does WORK as part of the system and it is part of what is actually driving profits for both fashion designers and their copycats.

    So if you want to get your panties in a frilly wad over art theft on PRINTS, feel free. But for anything else, and even for a bit of the former, you really REALLY don't get the system as a whole.

    But replicas of print garments, while illegal, don't actually hurt the brands as much as people claim. And not because they are already sold out (which isn't always true) or because replica clients would never buy brand at brand prices anyway, or all the reasons that keep getting thrown around.

    Lolita brand and replicas are part of a symbiotic relationship that is seen in all the areas I already went into detail about.

    People don't have to like something so subjective. But this is one of those cases where what is "illegal" or "legal" is not the best indicator of whether or not the actions are harmful and detrimental to lolita fashion, the major brand houses, or the artists.

    People act like they can validate or vilify one side or the other, but they are both part of the same damn system. People's loyalty to brand or replicas is also part of the system.The whole replica fight is part of market validation of the original product. The system is set up this way to enable fast fashion turnover. People act like there is a side to chose, but its all part of the fashion loop driving profits for all of the parties involved, like it or not.

    Sorry if you find that wordy or redundant, but every replica debate I've seen seems to be missing that vital point. Because if you realize its all one symbiotic profitable relationship, there is no debate. There are no sides. Only moral offense at art theft which if theft only in the legal sense of the world and none of the traditional consequences.

    I would love to buy the original of all the lolita dresses I want. But I can't justify spending $600+ for a used dressed that usually has stains on it and god knows what the girl did in it. I agree, it's just so shitty trying to find a good second-hand dress without the jacked up price, and while I understand economics, supply and demand, yada yada.....     I was with you until this. Most laws exist to protect people's property, intellectual and otherwise. Innovation worth protecting by law is so tied up in profits that separating them for the purpose of this argument is arbitrary and superfluous.

    Brands do care and have spoken out about their designs being copied. They don't like it. Even if the protection they can seek under the law is limited to prints doesn't entitle Oo jia or DoL or any one else to profit from stolen artwork.

    Tell yourself whatever you want but don't expect anyone else to buy your excuses.

    Just by the way you might want to use lolibrary if you are looking for things that aren't super popular prints. There tends to be more stuff there. I don't see this particular dress on a quick search for dots or stripes under innocent world though.
