are always involved if you are a photographer using other people's
photos. I'm not into law, but the general ruling is sort of like this:
If
you're derping around and say, making your own photobook or calendar of
yourself/your friends for non-profit purposes with pictures of
yourselves, it's pretty much up to you and you and/or your friends, most
friends don't bother each other for model waivers if it's just for
private use and not gonna get "published and distributed".
If,
per se, you wanted to do a photobook/calendar/etc with many cosplayers
and sell it/distribute it, you'd need them to sign model releases saying
you have the right to use their image. Then depending on where you were
working, you may need a shooting permit etc. though some places say the
moment you bust out a tripod you are into "professional" grounds
thereby requiring said permits.
Depends on your location etc.
BUt.... really if you're interested in something like a photobook, why
not contact one of the folks who published a photobook before? I'm
drawing blanks on the people's names/organizations but there are several
out in the US. Japan has even more photobooks etc. if you know someone
there you can ask. |
