I don't know who thought this was a good idea, but this is just a clusterfuck waiting to happen.

tldr: If we think your cosplay/fanart/amv/etc infringes on a trademark/copyright, we have the right to tell you to remove it.

    >> Anonymous 02/07/11(Mon)20:01 No.4105910
In all seriousness, this is pretty much the policy of most AA. They will only act to avoid legal trouble because they realize conventions are pretty much a giant middle finger to copyright. However, most creators and companies will take it in stride because, well, you can't alienate your fans by being a dick plus done moderately will count as free exposure.

This new rule however covers COSPLAY and AMV's.

Cosplay IS the art of imitating... art. :l

It's pretty much saying that if Funimation doesn't like the way you are identifying yourself as Russia, they can ask you to take off your Russia cosplay. :l

How can they tell us to take off a cosplay though... We are not selling or making profit off of the costume there for is not part of copyright infringement.

Katsucon's policy now and forever is to have zero tolerance towards copyright violations as part of any of our convention functions. This includes the Artist Alley, Anime Music Videos, Cos-Play, and other convention programming. If a valid copyright holder finds, in any venue of the convention, a perceived violation of their intellectual property and thus makes a complaint to our staff, we will act on that complaint and request that the offensive materials be removed from public display.

Violation of their intellectual property =/= makign a profit off of it.

Doesn't mean I'd listen. I'd give them the biggest middle finger, tell them they're a piss-poor company anyway, and strut off.
    >> Anonymous 02/07/11(Mon)20:18 No.4105968
On a different note, is katsucon worth going to? I live in the DC metro area but haven't purchased a ticket yet.

I'm so sorry. >: I wasn't pinpointing the Hetalia fandom, I just meant in general.

I mean, who is to say that I dress up as Tsuna from Hitman Reborn in a dress *???* and get told by a Funi agent to change.

It's a little ridiculous considering that cosplay shouldn't follow the rules of AA as we are not SELLING our .... "finished product"

    >>4105973

OH no lol I wasn't bitching at you about using Hetalia as an example. It doesn't matter what you would say, I'd have the same reaction. I'm probably just a little more angrier than usual tonight, but nothing at you bro.

Also, the cons that do this for Artist's Alley pisses me off real bad too. I know a lot of artist's need that money for fucking bills, and a lot of people don't tend to buy original content.

You don't have to profit from it to be copyright infringement. Just ask all those youtube videos being taken down due to 3 seconds of background music or the list of authors on fanfiction.net that bans any fanfic of their work.

By a stretch, they can argue that your representation isn't one they approve or buying ebay costumes is a form of cutting potential profits by way of distracting from official merchandise, kinda like how some manga creators are against doujins.

Amen. What I heard some people do is have their fanart with their OC and when the con cops come around, tell them that's it's only to display their variety of abilities for outside commissions. That usually satisfies them because if by the offchance they get into legal trouble, they have a defense by saying you lied and so are free of liability.

Doesn't Otakon have a policy similar to this regarding AMV's? EX. Don't put a Warner Brothers logo in a parody trailer.

    hehe everyone overreacting as usual.

this was a cover your ass move. They have either been threated with a lawsuit or have seen coming and are just setting up to make sure that they dont get shit on.

youre cosplays are just fine. but the wording it to cover their asses cause no one likes being sued
    >> Anonymous 02/07/11(Mon)20:35 No.4106011
Don't worry guys, this won't change much of anything if at all. Fan stuff has always been hovering around copyright legalities and this is just another instance of a con trying to have their legal defense in writing so, when approached, they can say 'oh well, it's not our fault they didn't listen. we tried.'

They will only step up when a legal representative or copyright holder have an official complaint, which won't happen unless you're table is full of mass produced bootleg from china.

Otherwise, say hello to one of the worst publicity you can do. The fans who care enough to put time and effort into making, drawing, or cosplaying your series are providing free advertisement and are often some of the bigger fans. Have a reputation of viciously going after fans is the same as going after your customers.

ITT: Faggots claiming that other people are faggots for being genuinely worried about future cons.

Just shut up. You'll be the first complaining if other cons ACTUALLY enforce this kind of shit.
    >> Anonymous 02/07/11(Mon)21:10 No.4106145
Yes cosplay is an infringement of intellectual property, and yes it is sometimes enforced. Disney's usually the big one, they don't let you enter the park in costume, and even on event days like Halloween where costumes are ok, they're really not that thrilled with anyone over the age of 12 dressing as their characters. The other company that enforces it is Shueisha, and they're the reason jump characters aren't allowed in WCS anymore. I know it seems really stupid and sucks, but fact is copyright law protects the original creator and fair use is a fairly narrow grey area.
    >> lilitu !!xrorRTcEU5x 02/07/11(Mon)21:10 No.4106147
honestly I can not see katsucon surviving much longer. they keep doing things to make people not want to go and this policy is only the latest one. I know that they have one more year with their contract with the Gaylord (which is a pretty hotel but horrible location for a convention), plus the gaylord is probably the most uptight place I have ever gone to a convention at (the staff got mad at a friend and I for coming off of an elevator too close to one of the other conventions being held last year). And Katsucon did loose a lot of money at last years convention too from what I've heard.

The smart thing to do would be to bring Katsu back into Washington DC proper.

    Washington Convention Center perhaps?

    >>4105885 If we think your cosplay/fanart/amv/etc infringes on a trademark/copyright, we have the right to tell you to remove it.

Not really, it says pretty clearly that they only plan to take action if the actual copyright holder tells them to, not some con staff or jelly third party.

Honestly, their policy doesn't sound too bad and it basically just an ass-covering disclaimer. It certainly sounds a lot better than Ohayocon, where they flat out banned fanart from the artists' alley (but not the dealers' room, creating yet another of their numerous shitstorms this year).

    >Washington Convention Center

That place is way to big and expensive for katsucon The DC convention center would be perfect for holding Otakon but not Katsucon.
    >> Anonymous 02/07/11(Mon)23:10 No.4106672
    This goes for any convention.

But Katsucon has a bad way of writing it.

Kastucon art department has always been special in many ways.

A few years ago some of a friends stuff got pulled at a better con than katsu. Normally she is very careful on what she makes, but that month a company created hats very similar to hers with the copyrighted character. She was not told to leave, just pack up that hat the company complained about.

No one can tell you to take off your cosplay, you are not making money from it and you would be naked. Unless you are naked you may be asked to please put something on. I would love to see Katsu security tell someone to take off their cosplay immediately due to copyright infringement. They don't have the right to force it off you. But if you are wearing mickey mouse and making a prons to sell you bet Disney is gonna sue your arse. And if you are making bootleg mickey cosplays to sell, Disney is gonna sue your arse.

    >>4105989

And youtube is profiting off those videos with advertising. Also that is taking original works and music and redistributing them in an edited format. Much different than animating your own fan creation by hand and adding home brewed music.
