SWEIGERT vs. DEPARTMENT OF THE ARMY

"D.G. Sweigert was a consultant employed by the U.S. Army Simulation, Training and Instrumentation Command (STRICOM) in Orlando, Florida. Mr. Sweigert received numerous awards and recognition for contributions to STRICOM in the areas of computer networking, developing SQL-Web interfaces for the Command and other technological advancements.

During his one year tenure at STRICOM, Sweigert observed widespread nepotism, conflicts-of-interest, improper contractor-government relationships, etc. When Mr. Sweigert complained that his employer was hiring an unusually high number of unqualified job applicant’s from the government program manager’s church, Mr. Sweigert was immediately re-assigned to new duties. Then when Mr. Sweigert complained that the command was about to purchase an electronic messaging system that did not comply with Department of the Army policy he was terminated without warning, notice or hearing.

Interestingly, the Plaintiff cites the Administrative Procedures Act (APA), 5 USC 702-706, that provides for judicial review of any administrative action that is 'arbitrary and capricious'.
