This responds to your Freedom of Information Act (FOIA) request of March 29, 2001, for records concerning Tass News Agency, ZF010161W. Your request was received in this office on May 8, 2001.

We have conducted checks of the automated Defense Clearance and Investigations Index and a search of the Investigative Records Repository to determine the existence of Army intelligence investigative records responsive to your request.

We have located the enclosed records pertaining to Tass News Agency, ZF010161W. We have completed a mandatory declassification review in accordance with Executive Order 12958. As a result of this review, it has been determined that the Army-originated information no longer warrants classification protection and is partially releasable to you. Fees for processing this request are waived.

Information has been sanitized from these records which would result in an unwarranted invasion of the personal privacy rights of the individuals concerned. This information is exempt from the public disclosure provisions of the FOIA pursuant to Title 5 U.S. Code (b)(6).

In addition, since the release of the information in the records would reveal the identity of confidential sources, it is exempt from public disclosure pursuant to Title 5 U.S. Code 552 (b)(7)(D) of the FOIA. The significant and legitimate governmental purpose to be served by withholding is that a viable and effective intelligence investigative capability is dependent upon protection of confidential sources.

The withholding of information by this office is a partial denial of your request. This denial is made on behalf of Brigadier General Keith B. Alexander, the Commanding General, U.S. Army Intelligence and Security Command, who is the Initial Denial Authority for Army intelligence investigative and security records under the FOIA. You may appeal this decision to the Secretary of the Army. If you wish to file an appeal, you should forward it to this office. Your appeal must be postmarked no later than 60 calendar days from the date of this letter. After the 60 day period, the case may be considered closed; however, such closure does not preclude you filing litigation in the courts.

During the processing of your request, information was disclosed which is under the purview of other government agencies. This office has no authority to release these records and they are being referred, along with your request, for appropriate action under the FOIA, and direct reply to you.

We are continuing to review records regarding other titles you have requested and will respond to you by separate correspondence when our review is complete.

The telegram requests that TASS News Agency be furnished information concerning reactions in the RP relative to the nuclear test ban treaty recently signed in Moscow, USSR (Documentary)

Source stated that the registered cable address of xxxx ix xxxxxxxxxx xxxxxxxxxxxxxxxxxxxxxxxxxxxxx (TASS), Office: Imprenta Franco, Telephone 2-2712, Avenida 6 Sur, number 10-90; Residence: xxxxxxxxxxxxxxxxxxxxxxxxxxxx both in Panama, RP. xxxx was formerly employed as a cable clerk with the warehousing firm La Byzcayna, Panama, RP, but was dismissed from his employment approximately one year ago for participating in Communist activities. Source furnished a physical description of xxxx as follows:

On 17 September 1963, the following information was obtained:

On 13 August 1963, xxxxxxxxxxxxxxxxxxxxxxxxx representative in the Republic of Panama of the USSR TASS news agency, dispatched the following collect cablegram (EXHIBIT I) of the TASS office in New York, New York:

Expecting remittance urgently. Please advise if funds cabled or air-mailed. Will appreciate your cooperation.

TRANSLATION OF REST OF DISPATCH WHICH IS IN SPANISH

Early this morning at the airport of this city, without further explanation four students with scholarships to the Patrice Lumumba University were prevented from boarding the plane. The incident caused great disturbance among the student circles and the Union of University Students released to the local press and radio a communique approved by the Executive Central Committee of said organization which states: "The Union of University Students energetically protests the attitude assumed by the Minister of Government and Justice, Mr. xxxxxxxxxxxx who in an arbitrary manner impeded early this morning the departure from the country of four university students who were traveling to the Soviet Union for the purpose of studying at the Friendship University. The measure adopted by Minister xxxxx attempts toward the most elementary democratic principles consecrated by our national constitution. The Union of University Students considers that the rights of four humble students to receive the benefits of a higher education are being trampled in this manner. The union of the University Students must qualify the measure in its strict anti-democratic sense and considers it proof that the policy of the oligarchy, which has not solved the educational problem of the Panamanian people, is to impede by all means that students of this country receive education where they are capable of doing so. For these reasons, the Union of University Students demands that the fellow members affected be allowed to exercise a right to which they are fully empowered." End of the communique which is signed by the Central Executive Committee of the Union of University Students. At the same time, the organization has referred the case to lawyers in order that those affected obtain the protection of the constitutional rights and be allowed to travel.

SUMMARY OF INFORMATION

On 17 September 1963, Source made available a verifaxed copy of a collect telegram (EXHIBIT I) dispatched by xxxxxxxxxxxxxxxxxxxxxxxxx representative in the Republic of Panama (RP) of the USSR TASS news agency, to the TASS office in New York, New York. The telegram, dated 31 August 1963, contains substantially the following information:

The Noveno Congreso Nacional - NCON (Ninth National Labor Congress), convened by the Federacion Sindical de Trabajadores de la Republica de Panama - FSTRP (Syndical Federation of Workers of the Republic of Panama), was held on 17 and 18 August 1963. The NCON was attended by 79 delegates representing labor, peasant, and civic organizations in the RP. The main topics discussed were:

a. The national economy

b. The position of the working classes in the economic development of the RP.

c. The agricultural problems and the antiquated methods of exploitation

d. The problems of the small industries and the artisans

e. The characteristics of the developed industries, and those of the foreign monopolies and the Canal Zone.

Without any doubt, the analysis of the NCON will be the starting point for a better understanding of the division between workers and exploiters; knowledge that will serve as a foundation for the new organized struggle of the RP unions. It is encouraging to note that a new quality is in the making in the Panamanian syndical movement, whose leaders work, struggle, and study to become more knowledgeable of the Panamanian reality and to contribute to its transformation.

On the afternoon of 30 August 1963, xxxxxxxxxxxxx Minister of Government and Justice, summoned four students to his office to give them the passports that had been taken away from them previously. The students xxxxxxxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxx xxxxxxxxxxxxxxxxxxxx and xxxxxxxxxxxxxxx, received scholarships to attend Patrice Lumumba Friendship University, Moscow, USSR; however, their passports were confiscated by order of xxxxxx at the moment they were to board the airplane that would have taken them to Moscow. Before xxxxxx returned the passports to the four students, he communicated with the President of the Supreme Court. The parents of the students had requested through the courts that the passports be returned, since they considered it inconceivable that people in a civilized country be denied the right to travel mainly because the local authorities do not approve of the country to where the students are to study.

The Chiriqui Land Company (CLC), subsidiary of the United Fruit Company, after having accepted the idea of conciliation and arbitration by the national authorities of the Inspeccion General de Trabajadores (Office of the Labor Inspector General), has refused to accept the document of conciliation presented by xxxxxxxxx, national government representative. The document presented by Inspector xxxxx sets rules for the dismissal of employees who engage in fights and similar offenses. It also asks for the reinstatement of workers who have been arbitrarily dismissed by the CLC. Since the CLC's refusal has created new problems for the banana workers, xxxxxxxxxxxxxx, Secretary General of the banana workers syndicate, and xxxxxxxxxxxxxxxxxxxx, the syndicate's lawyer, have stated that they will seek all lawful means and resources to obtain the reinstatement of employees arbitrarily dismissed. Requena added that as a last step, the syndicate is ready for a partial or total strike to back up the fair demands of the workers.                   (Documentary)

On 28 August 1972, Source 22310076 (Project 2809), a usually reliable source of the 470th Military Intelligence Group, Fort Amador, Canal Zone, stated substantially as follows:

A Soviet journalist, nfi [no further information], reported to be a Tass news agency representative arrived at Tocumen International Airport (TIA), Panama City, PN, 23 August 1972. At the airport he was greeted by xxxxxxxxxxx, a Panamanian journalist reputed to be a member of the Communist Party of Panama.

According to administrative personnel at TIA, the Soviet journalist missed a Panama Air Force flight that transported a University of Panama delegation to Havana, Cuba on 23 August  1972, and therefore decided to stay in Panama.

AGENT'S NOTES: Tass is the official news agency of the Union of Soviet Socialist Republics. xxxxxxxxxxxxxxxxxx was a high level member of Partido Del Pueblo (People's Party), the Communist Party of Panama and was the editor of Momento the official PDP newspaper.

On 29 August 1972, Source 22310260 (Project 2809), a usually reliable source of the 470th Military Intelligence Group, Fort Amador, Canal Zone, was debriefed concerning events in PN. Source stated substantially as follows:

xxxxxxxxxxxxxxxxxxxxxxx, reportedly a Soviet journalist, and his wife, xxxxxxxxxxxxxxxxx, carrying Soviet passports xxxxxx and xxxxxx respectively, arrived at Tocumen International Airport (TIA), Panama City, PN, aboard KLM Royal Dutch Airlines flight 774, at 1400 hours, xxxxxxxxxxxxxx. They were met at TIA by xxxxxxxxxxxxxxxxxx, a high level member of the Partido del Pueblo (PDP - People's Party) and editor of the official PDP newspaper, Momento.

AGENT'S NOTES: Tass is the official news agency of the Union of Soviet Socialist Republics. PDP is the Communist party of PN. xxxxxxxxxxxxxxxxxxxxxxx has been previously reported as xxxxxxxxxxxxxx aka: xxxxxxxxxxxxxxxx, a Tass news representative. According to the Official Airline Guide, International Edition, Volume 16, Number 15, dated August 1972, KLM flight 774 originates in Lima, Peru. It departs Lima at 1035 enroute, non-stop, to TIA where it is scheduled to arrive at 1350 hours the same day. KLM flight 774 flies on Tuesday only and, xxxxxxxxxxxxxx was Wednesday. Reference is made to Agent Reports 0020-72 and 0026-72, subject as above, dated 25 and 30 August 1972, respectively.

xxxxxxxxxxxxxxx, Russian national representing the news agency Tass, Passport number xxxxxx was registered in room 511 of the hotel El Continental, Panama City. Registered with him were his wife and a young son. On 5 September 1972 xxxxx paid a hotel bill of $480. He had been staying at the hotel since about 23 August and indicated to hotel personnel upon paying his bill that he had plans to stay at the hotel until around 20 September. He gave his permanent address as xxxxxxxxxxxxxxxxxxxxxxxxx. His room reservation was made through KLM, Royal Dutch Airlines.

On 7 September 1972, Source 22310076 (Project 2809), a usually reliable source of the 470th Military Intelligence Group, Fort Amador, Canal Zone, furnished the following information:

xxxxxxxxxxxxxxx, a Russian, was born on xxxxxxxxxx, in xxxxxxxxxxx (sic), [1 line redacted], parents, both Russian nationals, were xxxxxxx and xxxxxxxxxx. Subject's spouse, also Russian, was xxxxxxxxxx, not further identified. xxxxx was physically described as having blue eyes, straight brown hair, white complexion and was 5' 7" in height. Reportedly, xxxxx did not have any distinguishing marks or features.

Arriving at Tocumen International Airport (TIA), Panama City, xxxxx entered PN on a Braniff flight, details unavailable, from Quito, Ecuador (EC) on xxxxxxxxxxx. Subject's passport, xxxxx was listed as being issued by the Ministry of Foreign Affairs of the UR on 14 September 1971--and valid until 14 September 1972--for the purpose of visiting various countries, not further described. xxxxx arrived in PN on a tourist card, xxxxx issued by Braniff Airlines in quito, EC, date not listed, and possessed via xxxxx granted by the PN embassy in Santiago, Chile (CI) on 27 June 1972. Authorization for visa was given by the PN Immigration Department in Panama city on 15 March 1972.

As required by PN law, xxxxx surrendered his passport to the PN Immigration Department on 1 August 9172, and, at that time, stated his intention to depart PN on or about 5 August 1972. xxxxx, who listed his profession as a journalist, not further identified, stated his residence in PN was to be the Hotel Lux, Panama City.

On 25 September 1972, Source 22310127 (Project 2807), a usually reliable source of the 470th Military Intelligence Group, Fort Amador, Canal Zone, stated substantially as follows:

On 16 September 1972, xxxxxxxxxxxxxx, a Soviet national, visited the public relations office for the 8th Congreso Interamericano de la Industria de la Construccion (Inter-American Congress of the Construction Industry) at El Panama Hotel, Panama city, Panama (PN) where the Congress was held from 18 - 22 September. xxxxxx introduced himself and presented an identification card which indicated that he was the TASS Correspondent in PN. He stated that he would employ xxxxxxxxxxxxxxxxxx, also a Tass correspondent in PN, on a contract basis. xxxxx expressed much interest in the Congress and attended its press conference held on 18 September at the offices of the Camara Panamena de la Construccion (Panamanian Board of Construction) in Panama city on 18 September. xxxxx speaks fluent Spanish and appeared to be exceptionally sensible and capable. He stated that he would remain in PN for a short period.

While in Panama (PN) in November and December 1971, xxxxx directed a letter, dated 23 November, to xxxxxxxxxxxxxxxxxx, PN Minister of Government and justice, requesting authorization to establish a TASS (News Agency of the Union of Soviet Socialist Republics) press office in Panama city. On 30 November 1971, the TASS credentials of xxxxx which identify him as the TASS correspondent in Peru, were lost by xxxxx in Panama City and subsequently came into the possession of the 470th Military Intelligence Group.

Having arrived at Tocumen International Airport (TIA), Panama City, xxxxx, along with his wife, xxxxxxxxxxxxxxxxxxxx and his son xxxxxxxxx entered PN on KLM (Royal Dutch Airlines) flight, details unavailable, from Lima, Peru (PE) on xxxxxxxxxxxxxx. He had an official passport xxxxx, which was listed as being issued by the Ministry of Foreign Affairs of the UR on 17 July 1967 and expiring on 4 March 1973 for the purpose of visiting various countries, not further described. xxxxx entered PN on a tourist visa, details unknown, granted by the PN consul in Lima, PE through authorization by cable #370 from the PN Ministry of Government and Justice on 21 July 1972.

xxxxx listed his residence while in PN as the Hotel Continental, Panama City. He reported his profession as journalist for the "News Agency of the Soviet Union."

xxxxx's spouse, xxxxxxxxxxxxxxxxxx who arrived jointly with xxx and his young son, was born xxxxxxxxxxx in xxxxxxxxxxx. Her parents were xxxxxxxxxxx (father) and xxxxxxxxxxxxxxxxxxxx, both Russians. xxxxxxxxxxxxxxxxxxxxxx was physically described as having dark brown eyes, straight black hair, "brownish" skin and 5' 3" in height.

xxxxxxxxxxx possessed passport xxxxx, issued by the Ministry of Foreign Affairs of the UR on 17 July 1967 and expiring 4 March 1973 for the purpose of visiting various countries, not further described. Entering PN under tourist status, xxxxxxx had two visas, one old one from a former trip to PN, details unavailable bearing xx and issued by the PN Consul in Lima, PE on 6 September 1971, and the present visa, xx, issued by the PN Consul in Lima, PE through authorization by cable #370 from the PN Ministry of Government and Justice on 21 July 1972. She listed her residence while in PN as being located on 55th Street, apartment #9A of the Adir Building, in the El Congrejo area, Panama City.

xxxxxxxxxxxxxxxxxxxxxx who arrived in PN jointly with his parents xxxxxxxxxxxxxx and xxxxxxxxxxxxxxx was born xxxxxxxxxxxxxxxxxx in xxxxxxxxxxxx. He was physically described as having brown hair, brown eyes, white complexion, and 3' 4" in height. He possessed collective passport xxxxx jointly with his mother xxxxxxxxxxxxxxxxxx. Likewise, he entered on the same tourist visa as that of his mother described above.

AGENT'S NOTES: This report constitutes a partial response to SICR #U-UCR-U0255, para 12a (2) (k). Reference Agent Report, subject as above, dated 29 August 1972, control number 0025-72, Agent Report, subject as above, dated 30 August 1972, control number 0026-72, and Agent Report, subject as above, dated 5 September 1972, control number 0027-72, in which xxxxx was identified as a TASS representative. xxxxxxxxxxxxxxx has been variously reported as xxxxxxxxxxxxxxxxxxxxxxxxxxxxxx and xxxxxxxxxxxxxxxx. Attention is invited above to the addresses reported for xxxxxxxxxxxxxxxx and his spouse xxxxxxxxxxxxxxxxxxxxxxxxx, the former listed his residence at Hotel Continental, the latter at the Adir Building, 55th Street, in the Congrejo area of Panama city. This difference is probably due to xxxxx's wife registering through PN Immigration some days later than her husband by which time another residence has apparently been established. Additionally, reported above is xxxxxxxxxxxxxxx's possession of two visas, one of them of an alleged former trip to PN. However, a review of the files of the Assistant Chief of Staff G-2, United States Army Southern Command (USARSO), Fort Amador, Canal Zone, revealed no record of said trip. On 13 December 1972 and 12 January 1973, Source 22310076 (Project 2807), a usually reliable source of the 470th Military Intelligence Group, Fort Amador, Canal Zone, furnished the following information concerning xxxxxxxxxxxxxxx, TASS correspondent in Panama (PN):

[Three lines redacted.] he was interested in providing some TASS-sponsored programs to the closed-circuit television station at the University of Panama (UP). The type of programs that xxxxx is willing to provide was not specified, but he did mention that he wants to hold future discussions with UP television officials in order to work out an agreement for the use of TASS news services by the UP television station. It is expected that this service will be provided free of charge because EFE, the Spanish news service, has already agreed to provide free use of its wire service in PN and it is expected that Prensa Latina, the Cuban news service, will follow suit. The UP television station will probably not take full advantage of the news services open to it until it is ready for open-circuit programming in the Panama City area early in 1973.
