The Defendant has breached the Claimants Human Rights and is in breach of Articles: Art. 2, Art. 5, Art. 8, Art. 12.

The Defendant has failed to put into place any legislative instrument of authority, giving protection to agents or sources of Intelligence in its war on terrorism in North Ireland and the Republic of Ireland.

The Defendant has and is recruiting agents and sources of Intelligence to conduct its war on terrorism, without any legal framework or legal procedures in place, deliberately placing the lives of all intelligence contacts at risk which includes the life of the claimant.

There is no oversight or effective control over the covert elements of the Intelligence Corps or its sub units (Force Research Unit/Joing Services Group), and others operating under the instruction and guidance of the defendant within the jurisdiction of Northern Ireland and that of the Republic of Ireland.

The Defendant has continually ignored correspondence addressed to the Prime Minister Tony Blair. The contents advised of the loss of life, the failure and the the lack of effective coordination of Intelligence activity between the Military, Security Service, PSNI (RUC).

The Defendant has and is willfully causing the Claimant to suffer which can only be regarded as a form of torture designed to humiliate and degrade the Claimant, causing the Claimant to suffer mental anguish. The Claimant seeks damages from the Defendant.

The Defendant continues to owe the Claimant a duty of care. The Claimant intends to lodge a complete statement (affidavit) in due course.

The First Defendant (Ministry of Dfense) and the Second Defendant (Edwin Bates) deliberately and willfully placed the life of the Claimant at rish. The Defendants made libelous and defamatory statements (publication) against the Claimant.

Further the Defendants mounted a campaign of slander against the Claimant, causing the Claimant's reputation and good name to suffer as a result.

The Force Research Unit (Intelligence Corps) who acted under the guidance and instruction of the First Defendant (Ministry of Defense), recruited the Defendant (Edwin Bates). However the First Defendant had identified the Second Defendant to the Claimant as a source of Intelligence and iformation.

It became apparent that the Second Defendant was also supplying Intelligence to the Royal Ulster Constabulary (PSNI) with or without the knowledge of the Army.

The Second Defendant deliberately and willfully with the cooperation of his handlers and the First Defendant victimized, harassed the Claimant effectively destroying the life of the Claimant.

As a result of the Defendants actions, the Claimant has suffered financial loss and incalculable loss to his good name and reputation, subsequently suffering mental anguish and distress as a result.

The force research unit was deployed in Northern Ireland in 1980 and given the job of recruiting and handling double agents who could infiltrate loyalist and republican terror groups. With a complement of about 100 soldiers, the FRU was one of three army-sponsored undercover intelligence squads in the province at the time. The others were 14 Company, which specialised in covert surveillance, and 22 Squadron SAS, which undertook "executive actions".

"That means they killed people," said an army source.

FRU was divided into detachments - north, south, east and west. Headquarters FRU dealt only with material supplied by a republican double agent, known only by the nickname Stakeknife. ... Sensitivity about the FRU is acute in the MoD, which has sought injunctions on newspapers that have attempted to reveal details of its operations. FRU still works in Northern Ireland, though it has changed its name to the joint services group.
